Terms and Conditions of Sale

These conditions of sale are entered into on the one hand by the company CAFES DU MONDE with a share capital of €5,000, whose registered office is located at 5 Petite rue du vieux marché aux vins, 67000 Strasbourg, registered in the Strasbourg Trade and Companies Register under number 894011402, hereinafter referred to as CAFES DU MONDE, and which manages the CAFES DU MONDE website, www.cafes-du-monde.fr and, on the other hand, by any individual or legal entity wishing to make a purchase via the website, www.cafes-du-monde.fr hereinafter referred to as “the buyer”.

Article 1. Object

These conditions of sale are intended to define the contractual relationship between CAFES DU MONDE and the purchaser and the conditions applicable to all purchases made via the CAFES DU MONDE website, www.cafes-du-monde.fr. The purchase of a product through this site implies unreserved acceptance by the buyer of these terms and conditions of sale, which the buyer acknowledges having read prior to ordering. Prior to any transaction, the buyer declares on the one hand that the purchase of products on the site www.cafes-du-monde.fr is not directly related to its professional activity and is limited to strictly personal use and, secondly, to have full legal capacity, enabling it to commit itself under these general terms and conditions of sale.

CAFES DU MONDE reserves the right to modify these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. As a result, the conditions applicable will be those in force on the date of the order by the buyer.

Article 2. Products

The products offered are those shown on the www.cafes-du-monde.fr website of CAFES DU MONDE, while stocks last. CAFES DU MONDE reserves the right to modify the product range at any time. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible but are not binding on the Seller. The sale of the products presented on the www.cafes-du-monde.fr website is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.

Article 3. Rates

The prices shown on the product sheets in the internet catalogue are in Euros (€) and include all taxes (VAT) applicable on the day the order is placed. Any change in the VAT rate may be reflected in the price of the products. CAFES DU MONDE reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalogue on the day of the order will be the only price applicable to the purchaser. The prices shown do not include delivery charges, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order. In mainland France, postage is free for orders of 49 euros or more, including VAT; for orders of less than 49 euros, including VAT, the buyer will be charged a flat-rate contribution to postage costs of between 4.99 euros and 5.90 euros, including VAT in mainland France.

Article 4. Ordering and payment

Before placing an order, the purchaser may, if they wish, create an account on the www.cafes-du-monde.fr/mon-compte website. The account creation section can be accessed directly from the menu bar. Each time they visit the site, buyers wishing to order or consult their account (orders, profile, etc.) must identify themselves using this information. The company CAFES DU MONDE offers the buyer the option of ordering and paying for its products using the following method:

– Payment by credit card (via the STRIPE system): the buyer selects the products they wish to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then chooses the method of payment: Payment by credit card. The next step is to check all the information, read and accept these general terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the “Confirm my order” button. If the payment is accepted, the order is recorded and the contract definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the purchaser may demand that the card payment be cancelled, and the sums paid will then be credited back or refunded. The bankcard holder is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement for the fraudulent debit and any bank charges that may have been incurred, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or 120 days if provided for in the contract with the bank. The amounts debited are reimbursed by the bank within a maximum of one month of receipt of the cardholder’s written objection. The holder will not be liable for any costs incurred in returning the sums.

Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement that you are fully aware of them and waiver of your right to invoke your own terms and conditions of purchase. All the data supplied and the recorded confirmation will constitute proof of the transaction. If the purchaser has an e-mail address and has entered it on the order form, CAFES DU MONDE will send confirmation of the registration of the order by e-mail.

Article 5. Reservation of ownership

The company CAFES DU MONDE retains full and complete ownership of the products sold until full payment has been received, in principal, costs and taxes included.

Article 6. Withdrawal

In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from the date of delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or reimbursement without penalty, with the exception of the cost of returning the product and subject to the following conditions: The product must be unopened and undamaged and returned in its original packaging with the original protective covers.

Article 7. Delivery

Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area, or to the relay point selected by the buyer. Orders are placed/delivered via LA POSTE COLISSIMO, a delivery service with tracking and delivery without signature. Delivery times are given as an indication only; if they exceed thirty days from the date of the order, the sales contract may be cancelled and the buyer reimbursed. The company CAFES DU MONDE may provide the purchaser by e-mail with the tracking number for their parcel. The buyer is delivered to their home by their postman or to a relay point if they have selected this option. If the purchaser is absent for home delivery, they will receive a delivery notice from their postman, allowing them to collect the products ordered from the nearest post office or parcel relay, within a period indicated by the postal services. The risks associated with transport are borne by the purchaser from the moment the items leave the premises of the company CAFES DU MONDE. The purchaser is obliged to check the condition of the packaging and the contents of the goods on delivery in the presence of the employee of the Post Office or the delivery person. In the event of damage in transit, any complaint must be made to the carrier within three days of delivery.

Article 8. Guarantee

All products supplied by CAFES DU MONDE are covered by the legal guarantee provided by Articles 1641 et seq. of the French Civil Code. In the event of non-conformity of a product sold, it may be returned to the company CAFES DU MONDE which will take it back, exchange it or refund it. All claims, requests for exchange or reimbursement must be made by post to the following address: CAFES DU MONDE, 5 Petite rue du vieux marché aux vins, 67000 Strasbourg, within thirty days of delivery.

Article 9. Liability

In the distance selling process, CAFES DU MONDE is only bound by an obligation of means. It may not be held liable for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.

Article 10. Intellectual property

All elements of the www.cafes-du-monde.fr website are and remain the exclusive intellectual property of CAFES DU MONDE. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, any elements of the site, whether in the form of photos, logos, visuals or text.

Article 11. Personal data

The company CAFES DU MONDE undertakes to preserve the confidentiality of information provided by the purchaser, which he or she may be required to transmit in order to use certain services. Any information concerning him/her is subject to the provisions of law no. 78-17 of 6 January 1978. Internet users therefore have the right to access, modify and delete information concerning them. Article 12. Settlement of disputes

These conditions of distance selling are governed by French law. For all disputes or litigation, the competent court will be that of Strasbourg.
